Author's supervision is carried out in accordance with the Code of Rules "Author's Supervision over the Construction of Buildings and Structures" SP 11-110-99, approved and put into effect by the Decree of the Gosstroy of the Russian Federation of 10.06.1999 No. 44 (hereinafter - SP 11-110-99, the Code of Rules) and Code of rules "Regulations on architectural supervision of the construction of buildings and structures" SP 246.1325800.2016, approved. by order of the Ministry of Construction of the Russian Federation of February 19, 2016 No. 98 / pr (hereinafter - SP 246.1325800.2016).

IMPORTANT! When issuing an order and maintaining a designer supervision journal, one should proceed from the fact that SP 11-110-99 is currently in force, however, the current SP 246.1325800.2016 also contains additional requirements, being a more complete list of rules that take into account modern standards (letter of the Ministry of Construction of the Russian Federation " On the application of SP 11-110-99 and SP 246.1325800.2016 "dated 02.06.2016 No. 20632-OG / 08).

Architectural supervision according to the introduction to SP 11-110-99 is a service provided by the documentation developer to the customer. In accordance with clause 3.1 of the Code of Rules, the expediency of supervision is determined by the customer, its immediate goal is to determine the compliance of the work being performed with the working documentation.

During supervision, a log is filled in. A completed sample of the construction supervision journal can be downloaded for free at the link: Author's supervision journal - sample.

In accordance with clause 5.1 of the Code of Rules, the journal is filled in by the designer and transferred to the customer. Also, in accordance with SP 11-110-99, a copy of the journal can be issued, which is reflected in the contract for the provision of supervision services.

The form of the journal of author's supervision of construction

In order to fill out the journal, use the forms given in Appendix A to SP 11-110-99, namely:

  • title page;
  • list of contractors;
  • list of persons conducting supervision;
  • visit registration sheet;
  • account sheet.

For capital construction facilities, the forms are approved by SP 246.1325800.2016 (Appendix E). In this case, one should also be guided by acts that establish special rules for logging in relation to individual objects. In particular, provided for in App. 3 to the order of the Ministry of Sports of the Russian Federation "On the approval of the form ... for the preparation and holding of the FIFA World Cup 2018 and the FIFA Confederations Cup 2017" dated 03.08.2015 No. 780 and form F-2 from the order of the Federal Road Traffic Agency "On approval of the collection of forms ..." dated 23.05. 2002 No. IS-478-r.

According to Appendix A to SP 11-110-99 and Appendix E to SP 246.1325800.2016, when registering a journal, one must bear in mind, in particular, the following:

  • the main document, according to the requirements of which the journal is filled out, is GOST 2.105-95 “Unified system for design documentation. General requirements for text documents”, put into effect by the Decree of the State Standard of the Russian Federation of 08.08.1995 No. 426 (hereinafter - GOST 2.105-95);
  • pages of the magazine are numbered;
  • the magazine is laced up;
  • the necessary signatures are affixed on the title page;
  • the magazine is sealed by the designer and the customer;
  • the prepared magazine is transferred by the customer to the contractor;
  • the author's supervision log is kept at the construction site for the entire period of construction.

Sample order for architectural supervision in construction

In accordance with paragraphs. 3.2, 3.6 SP 11-110-99 the main documents for carrying out field supervision are:

  • contract, if architectural supervision is carried out with a design method based on contractual relations;
  • administrative document (order), if one organization carries out both design and investment with the construction of the facility.

According to paragraph 4.4 of SP 11-110-99, the appointment of a manager and specialists directly exercising field supervision is carried out on the basis of an order. A sample of the order on author's supervision can be downloaded from the link: Order for architectural supervision - sample. According to paragraph 4.3 of SP 11-110-99, the chief architect or chief engineer is appointed as the head of the persons conducting supervision.

The signed order is brought to the attention of the customer, after which he also notifies the contractor and state regulatory authorities.

Keeping a log of architectural supervision of construction

  • the log displays each visit to the object (clause 5.4 of SP 11-110-99);
  • a record of supervision work is confirmed by the signatures of authorized representatives of the contractor and the customer (clause 5.4 of SP 11-110-99);
  • if the architectural supervision specialists did not have any comments, an entry in the journal is still made out (clause 5.4 of SP 11-110-99);
  • the marks and requirements of persons conducting supervision must be clearly stated with the necessary references (clause 5.5 of SP 11-110-99).

For the qualitative implementation of supervision and keeping a log, persons conducting supervision are granted the right (clause 6.1 of SP 11-110-99):

  • to visit facilities;
  • familiarization with technical documentation;
  • control over the fulfillment of the requirements that they noted in the log;
  • appeal to government agencies with proposals to suspend works produced with violations and prevent copyright infringement.

In addition to the obligation to regularly keep a journal of architectural supervision, the persons exercising supervision are also responsible (clause 6.2 of SP 11-110-99):

  • to check the compliance of works with documentation;
  • to control the quality and reliability of the work performed;
  • monitor the need for changes to the documentation;
  • assist the persons performing the work and the customer in familiarizing themselves with the documentation;
  • inform the customer about the untimely elimination of the comments indicated in the author's supervision journal.

Report on the results of architectural supervision of construction

According to clause 6.4 of SP 246.1325800.2016, persons exercising supervision receive an assignment to conduct it, after which they draw up a report. The report is drawn up by the time of signing the acts of acceptance of work on field supervision and includes the following points:

  • list of completed works on architectural supervision;
  • identified defects;
  • identified deviations from technical requirements;
  • assessment of identified nonconformities;
  • the reasons for the identified shortcomings;
  • terms for elimination of shortcomings revealed in the course of supervision.

After the construction is completed, a single summary report is compiled. In accordance with the note to clause 6.4 of SP 246.1325800.2016, if there is a need to draw up interim reports, this is indicated in the contract for supervision. There are also reporting dates.

The recommended form of assignment for the performance of works on field supervision (Appendix D to SP 246.1325800.2016) contains the column "Report on the completion of the assignment". In this column, a mark is made on the report, which is drawn up as a separate document. It specifies:

  • name of objects of work performance;
  • terms of supervision work and representatives of third-party organizations with whom the specialist exercising supervision interacted;
  • a list of what has been checked;
  • identified defects;
  • proposals for their elimination;
  • proposals for correcting the documentation (if required);
  • consulting services rendered to the customer and contractor;
  • problematic issues;
  • annexes to the report.

In accordance with Part 1 of Art. 53 of the Town Planning Code of the Russian Federation construction control:

  1. Carried out in the process:
    • construction;
    • reconstruction;
    • overhaul;
  2. To check compliance:
    • project documentation;

Under the control (supervision) of compliance with the requirements of technical regulations in accordance with Art. 2 of the Law "On Technical Regulation" dated December 27, 2002 No. 184-FZ is understood as:

  1. Verification of compliance by organizations and private entrepreneurs:
    • technical requirements for products;
    • or requirements for the product and the process of its design, installation, construction, etc.
  2. Taking action based on the results of the audit.

Certain types of work involve the maintenance of building control and technical supervision logs. So, in GOST R 56254-2014 “National Standard of the Russian Federation. Technical supervision at cultural heritage sites. General Provisions” established the maintenance of a log of technical supervision of the work on the preservation of a cultural heritage site.

About examples of filling out the journal of architectural supervision of construction and the journal of construction control and technical supervision

In addition to the completed sample of the author's supervision journal presented in this article, as well as the form of the construction control and technical supervision journal (on the example of welding), the following can be indicated as features of filling in the relevant journals and conducting control (supervision):

  • acceptance of work and signing of acts is not the only form of construction control and technical supervision (decree of the 17th Arbitration Court of Appeal of December 22, 2008 No. 17AP-9259 / 2008-AK in case No. A60-30195 / 08);
  • failure to conduct control in cases where it is mandatory may entail liability under Art. 9.4 of the Code of Administrative Offenses of the Russian Federation, and the absence of marks on filling in the relevant journals will be evidence of such an offense (decree of the 8th Arbitration Court of Appeal of August 11, 2017 No. 08AP-8958 / 2017 in case No. A75-5176 / 2017);
  • in case of disputes about payment for services under architectural supervision contracts, duly completed logs are evidence of the provision of services (Decree of the Arbitration Court of the ZSO of June 24, 2016 No. F04-2271 / 2016 in case No. A27-17534 / 2015).

1 AREA OF USE

1.1 This document establishes the recommended provisions for organizing and maintaining field supervision at construction sites*.

1.2 The document is intended for use by developers of project documentation (hereinafter referred to as designers), developers (hereinafter referred to as customers), construction and installation organizations, state supervision bodies, other legal entities and individuals (including foreign ones) - participants in the investment process during the construction of facilities.

1.3 The document is mandatory in the following cases:

the implementation of field supervision in accordance with this joint venture is provided for by an agreement between the customer and the designer or an administrative document (order) of the organization that designs, invests and builds the facility.

3 DEFINITIONS

In this regulatory document, the following terms are used with their respective definitions.

3.1 Author's supervision- one of the types of services for the supervision of the author of the project and other developers of project documentation (individuals and legal entities) for construction, carried out in order to ensure the compliance of the decisions contained in the working documentation with the construction and installation work performed at the facility. The need for architectural supervision is within the competence of the customer and, as a rule, is established in the assignment for the design of the facility.

3.2 Treaty- the main document regulating the relationship of the parties, establishing their rights and obligations for the implementation of architectural supervision in the contract method of organizing design. This agreement may provide for technical supervision.

3.3 Customer(developer) - a natural or legal person who organizes and finances the construction of an object.

3.4 Contractor- an individual or legal entity that is the executor of construction and installation works at the construction site.

3.5 Designer- an individual or legal entity that, as a rule, has developed working documentation for the construction of an object and carries out architectural supervision.

3.6 Administrative document(order) - the main document for the implementation of architectural supervision in the design, investment and construction of an object by one organization.

4 ORGANIZATION OF AUTHOR'S SUPERVISION

4.1 Architectural supervision is carried out on the basis of an agreement (regulatory document) and is provided, as a rule, during the entire period of construction and commissioning of the facility, and, if necessary, the initial period of its operation.

4.3 Author's supervision in the case of its implementation by a legal entity is carried out by specialists - developers of working documentation, appointed by the management of the organization. As a rule, the chief architect or chief engineer of the project is appointed as the head of the specialists exercising architectural supervision.

4.4 The appointment of a manager and specialists responsible for carrying out architectural supervision is made by order of the organization and brought to the attention of the customer, who informs the contractor and the State Architectural and Construction Supervision authorities about the decision.

4.5 Specialists who carry out architectural supervision go to the construction site for intermediate acceptance of critical structures and examination of hidden work within the time frame stipulated by the schedule, as well as on a special call from the customer or contractor in accordance with the contract (regulatory document).

4.7 The customer is obliged to provide specialists who carry out architectural supervision with equipped office premises, means of communication, transport, etc. in accordance with the contract.

5 PROCEDURE FOR KEEPING THE AUTHOR'S SUPERVISION JOURNAL

5.1 When exercising architectural supervision over the construction of an object, a journal of architectural supervision of construction * (hereinafter referred to as the journal) is regularly maintained, which is compiled by the designer and transferred to the customer. Forms for filling out the journal are given in Appendix A.

5.2 Logging can be carried out both for the construction site as a whole, and for its start-up complexes or individual buildings and structures.

5.3 The design of the journal should be carried out in accordance with GOST 2.105. The journal must be numbered, laced, decorated with all signatures on the title page and sealed with the customer's seal. The magazine is transferred by the customer to the contractor and is located at the construction site until it is completed. The journal is filled in by the head or specialists exercising architectural supervision, the customer and an authorized person of the contractor.

5.4 Each visit to the construction site by specialists is recorded in the journal. The record of the work carried out on field supervision is certified by the signatures of the responsible representatives of the customer and the contractor. Recording is also carried out in the absence of comments.

5.5 Records and instructions of specialists are set out clearly, with the necessary references to the current building codes and regulations, state standards, technical specifications.

6 BASIC RIGHTS AND OBLIGATIONS OF SPECIALISTS CARRYING OUT AUTHOR'S SUPERVISION

6.1 Fundamental rights

6.1.1 Access to all construction sites under construction and places of construction and installation works.

6.1.2 Acquaintance with the necessary technical documentation related to the construction object.

6.1.3 Monitoring the implementation of the instructions entered in the log.

6.1.4 Making proposals to the bodies of the State Architectural and Construction Supervision and other bodies of architecture and urban planning to suspend, if necessary, construction and installation work performed with identified violations, and to take measures to prevent violation of copyright in a work of architecture in accordance with the law.

6.2 Key responsibilities

6.2.1 Selective verification of compliance of construction and installation works with working documentation and the requirements of building codes and regulations.

6.2.2 Selective control over the quality and compliance with the technology of production of works related to ensuring the reliability, strength, stability and durability of structures and installation of technological and engineering equipment.

6.2.3 Timely resolution of issues related to the need to make changes to the working documentation in accordance with the requirements of GOST R 21.101, and control over execution.

6.2.4 Facilitating the familiarization of workers involved in construction and installation work, and representatives of the customer with design and working documentation.

6.2.5 Informing the customer about the untimely and poor-quality implementation of the instructions of the specialists who carry out architectural supervision, in order to take prompt measures to eliminate the identified deviations from the working documentation and violations of the requirements of regulatory documents.

6.2.6 Participation:

in the examination of works concealed by the erection of subsequent structures, the quality of which determines the strength, stability, reliability and durability of buildings and structures under construction;

in acceptance in the process of construction of individual critical structures.

6.2.7 Regular logging and performance of other works and services specified in the contract (mandatory document).

1 AREA OF USE

1.1 This document establishes the recommended provisions for organizing and maintaining field supervision at construction sites*.

* The concept of "construction" includes new construction, expansion, reconstruction and technical re-equipment.

1.2 The document is intended for use by developers of project documentation (hereinafter referred to as designers), developers (hereinafter referred to as customers), construction and installation organizations, state supervision bodies, other legal entities and individuals (including foreign ones) - participants in the investment process during the construction of facilities.

1.3 The document is mandatory in the following cases:

the implementation of field supervision in accordance with this joint venture is provided for by an agreement between the customer and the designer or an administrative document (order) of the organization that designs, invests and builds the facility.

2 REGULATORY REFERENCES

This Code of Practice makes reference to the following standards:

GOST 2.105-95 ESKD. General requirements for text documents;

GOST 21.101-97 SPDS. Basic requirements for design and working documentation.

3 DEFINITIONS

In this regulatory document, the following terms are used with their respective definitions.

3.1 Author's supervision- one of the types of services for the supervision of the author of the project and other developers of project documentation (individuals and legal entities) for construction, carried out in order to ensure the compliance of the decisions contained in the working documentation with the construction and installation work performed at the facility. The need for architectural supervision is within the competence of the customer and, as a rule, is established in the assignment for the design of the facility.

4.3 Author's supervision in the case of its implementation by a legal entity is carried out by specialists - developers of working documentation, appointed by the management of the organization. As a rule, the chief architect or chief engineer of the project is appointed as the head of the specialists exercising architectural supervision.

4.4 The appointment of a manager and specialists responsible for carrying out architectural supervision is made by order of the organization and brought to the attention of the customer, who informs the contractor and the State Architectural and Construction Supervision authorities about the decision.

4.5 Specialists who carry out architectural supervision go to the construction site for intermediate acceptance of critical structures and examination of hidden work within the time frame stipulated by the schedule, as well as on a special call from the customer or contractor in accordance with the contract (regulatory document).

4.6 The head of architectural supervision issues tasks to specialists and coordinates their work on conducting architectural supervision at the facility.

4.7 The customer is obliged to provide specialists who carry out architectural supervision with equipped office premises, means of communication, transport, etc. in accordance with the contract.

5 PROCEDURE FOR KEEPING THE AUTHOR'S SUPERVISION JOURNAL

5.1 When exercising architectural supervision over the construction of an object, a journal of architectural supervision of construction * (hereinafter referred to as the journal) is regularly maintained, which is compiled by the designer and transferred to the customer. Forms for filling out the journal are given in the appendix.

5.2 Logging can be carried out both for the construction site as a whole, and for its start-up complexes or individual buildings and structures.

5.3 The design of the journal should be carried out in accordance with GOST 2.105. The journal must be numbered, laced, decorated with all signatures on the title page and sealed with the customer's seal. The magazine is transferred by the customer to the contractor and is located at the construction site until it is completed. The journal is filled in by the head or specialists exercising architectural supervision, the customer and an authorized person of the contractor.

After construction is completed, the contractor hands over the magazine to the customer.

5.4 Each visit to the construction site by specialists is recorded in the journal. The record of the work carried out on field supervision is certified by the signatures of the responsible representatives of the customer and the contractor. Recording is also carried out in the absence of comments.

5.5 Records and instructions of specialists are set out clearly, with the necessary references to the current building codes and regulations, state standards, technical specifications.

6 BASIC RIGHTS AND OBLIGATIONS OF SPECIALISTS CARRYING OUT AUTHOR'S SUPERVISION

6.1 Fundamental rights

6.1.1 Access to all construction sites under construction and places of construction and installation works.

6.1.2 Acquaintance with the necessary technical documentation related to the construction object.

6.1.3 Monitoring the implementation of the instructions entered in the log.

6.1.4 Making proposals to the bodies of the State Architectural and Construction Supervision and other bodies of architecture and urban planning to suspend, if necessary, construction and installation work performed with identified violations, and to take measures to prevent violation of copyright in a work of architecture in accordance with the law.

6.2 Key responsibilities

6.2.1 Selective verification of compliance of construction and installation works with working documentation and the requirements of building codes and regulations.

6.2.2 Selective control over the quality and compliance with the technology of production of works related to ensuring the reliability, strength, stability and durability of structures and installation of technological and engineering equipment.

6.2.3 Timely resolution of issues related to the need to make changes to the working documentation in accordance with the requirements of GOST 21.101, and control over execution.

6.2.4 Facilitating the familiarization of workers involved in construction and installation work, and representatives of the customer with design and working documentation.

6.2.5 Informing the customer about the untimely and poor-quality implementation of the instructions of the specialists who carry out architectural supervision, in order to take prompt measures to eliminate the identified deviations from the working documentation and violations of the requirements of regulatory documents.

6.2.6 Participation:

in the examination of works concealed by the erection of subsequent structures, the quality of which determines the strength, stability, reliability and durability of buildings and structures under construction;

in acceptance in the process of construction of individual critical structures.

6.2.7 Regular logging and performance of other works and services specified in the contract (mandatory document).

This agreement may provide for technical supervision. 3.3 Customer (developer) - a natural or legal person who organizes and finances the construction of an object. 3.4 Contractor - an individual or legal entity that is the contractor of construction and installation works at the construction site. 3.5 A designer is an individual or legal entity who, as a rule, has developed working documentation for the construction of an object and carries out architectural supervision. 3.6 Regulatory document (order) - the main document for the implementation of architectural supervision in the design, investment and construction of an object by one organization. 4 ORGANIZATION OF AUTHOR'S SUPERVISION 4.1 Architectural supervision is carried out on the basis of an agreement (regulatory document) and is carried out, as a rule, during the entire period of construction and commissioning of the facility, and, if necessary, the initial period of its operation. 4.2 The terms of works on architectural supervision are established by the schedule attached to the documents specified in 3.2 and 3.6. 4.3 Author's supervision in the case of its implementation by a legal entity is carried out by specialists - developers of working documentation, appointed by the management of the organization.
